1. CONFIRMATION OF RESOLUTIONS PASSED BY CIRCULATION

2. CONVERSION OF LEASE HOLD RIGHTS TO FREE OLD RIGHTS IN RESPECT OF SY NO. 101.

Ref:- Station Headquarter letter No. Bd/Gen/Q, dated 25th Feb. 2014.

OFFICE REPORT

This is bring to the notice of the Board that the freehold application of Shri Tanuj Pandey, dated 05-07-2001 on the subject matter was placed before the Cantt. Board Ranikhet vide Resolution No. 1(8), dated 02-12-2002, it was resolved that “the matter be referred to the local Military Authorities for obtaining their views/comments whether the site in question is required for any specific project or other military purposes be giving 2 months time for such reference. If no reply is received within the prescribed period a self contained proposal for grant of free hold rights will be projected to the Principle Director, Defence Estates. The matter was also taken up with LMA for their views. The same was not received within stipulated period. However 25% of the estimated conversion cost of Rs. 1,64,300/- was deposited by the HOR as per prevailing rate of STR at that time vide Cantt. Board receipt No. 370011, dated 09-01-2001.

At present a letter was received from Station Headquarter, Ranikhet for examine the matter in detail and obtaining comments and recommendations from this office alongwith Quartermaster General’s Branch, Dte Gen LWE/Pol(Cantts), Sena Bhawan, New Delhi letter No. A/75751/FH/1299/Ranikhet/Pol(Cantts) dated 31st January, 2014 regarding conversion of lease hold rights to free old rights in respect of Sy No. 101 wherein para 2(b) it is mentioned that “ whether there is any future planning for utilization of land of this property for Defence use”.

The Board may consider the matter accordingly.

RESOLUTION

2. Considered and matter discussed at length. In this connection elected member told that Board have already taken conversion cost i.e. 25% of the total conversion cost so process of free hold be expedited and NOC be obtained from LMA. CEO advised the Board that if Board desires to use the said site and premises for guest house, holiday home for defence officials (Army and Civil defence), in this regard resumption and reclassification of the land from B3 lease land to C will be required.

Further Board unanimously decided that Board has given a split verdict in this regard Board decided that LMA has full liberty to give its NOC as per their requirement.

3. TERMINATION OF LEASE OF SURVEY NO. 100

Reference DEDG letter No. 723/A/3/L/DE/2007, dated Dec 19th, 2012 and application dated March 30th, 2013 received from Shri B.C. Shah, Jiwan Villa, Near Civil Hospital, Ranikhet.

OFFICE REPORT

This is bring to the notice of the Board that the applicant of Survey No. 100 has applied time to time for renewal of lease. But the site comprising G.L.R. survey No. 100 measuring 0.397 acres is held on Cantt Code 1912 under the management of Cantt Board classified as B-3 situated within the notified civil area and entered in G.L.R. in the names of Smt. Hari Priya widow of late Jeewan Lal Sah, Smt. Sheela Sah, Smt. Susheela Sah, Shri Bhagwan Chandra Sah, Shri Prakash Chandra Sah, Km. Manju Sah, Km. Rashmi Sah. The lease has been expired on 31st Dec. 1978. Previously the site comprising G.L.R. Sy. No. 100 was under the management of D.E.O. Bareilly, but now the same has been notified as civil area vide S.R.O. No. 74, dated 01st May, 1985. As per DEO Bareilly letter No. MEO/BLY/RKT/44/E1, dated Oct 16th, 1978, wherein it is mentioned that “ the site in question may be taken over on the expiry of this period i.e. 31-12-1978 or earlier at the option of lesser in terms of the provisions of the resumption clause in the lease ”. In this connection a legal advice from Cantt Board Legal Advisor has also been obtained in this regard whereas he has opined that a notice of termination under Section 106 of the Transfer of Property Act should be issued as required under section 116 of the T.P. Act to the legal heirs/H.O.R’s. After the expiry of the notice the persons concerned will be treated as unauthorized occupant and eviction process should be initiated under PPE Act and the arrears of lease rent can be recovered under section 7(2) Public Premises Erection Act, 1971.

The matter is placed before the board for further course of action.

RESOLUTION

3. Considered and Board resolved that the lease comprising GLR Sy. No. 100 has been expired, thus mutation can’t be done at this stage so concerned will be treated as unauthorized occupant and the advice from the PDDE be obtained that, should eviction process be initiated under PPE Act and the arrears of lease rent can be recovered under section 7(2) Public Premises Erection Act, 1971 as matter is very old and it is come to the notice recently.

5. Considered. Further Board resolved that extra teacher can’t be provided to the Cantonment Primary School, Sadar Bazar at this stage.

6. PROPOGATION OF ACCURAL BASED ACCOUNT SYSTEM IN 60 CANTONMENT BOARDS AND TRAINING OF STAFF OF CANTONMENT BOARDS ON ABAS

Ref:- C.B.R. No. 49, dated 30-04-2014 and DGDE letter No. 56/15/DGDE/Coord/Double Entry, dated 25th April, 2014.

It is stated that as per Board resolution, an advertisement was published in the daily news paper Amar Ujala and Dainik Jagran on dated 15-05-2014 vide this office letter No 232/C.A./14, dated 12-05-2014 In this connection 14 numbers of application could be received within the stipulated period in this office, out of which Shri Kapil Kumar Agarwal & Associates, B-155, Jigar Colony, Moradabad has quoted lowest rates @ Rs. 21,500/- per month and also quoted 18 years experience for Consultant and other accounts matters. The qualification of Shri Kapil Kumar Agarwal & Associates, B-155, Jigar Colony, Moradabad is B.Com, FCA, DISA.

Hence the matter is being put up before the Board for consideration.

6. Considered and approved the L1 on purely temporary/honorarium basis till next arrangement. Further Board resolved that the necessary agreement be done between Cantonment Board and party and Board have liberty to terminate his services after giving 15 days prior notice.

7. POSTPONDING/CANCELLATION OF MUTATION OF SY.NO. 127

Reference Civil Area Committee Resolution No. 3, dated 26th February, 2014 confirmed vide C.B.R. No. 2, dated 20-03-2014.

OFFICE REPORT

It is submitted that the matter regarding mutation of Survey No. 127 was placed before the C.A.C. in its meeting held on 26th February, 2014 which was confirmed vide C.B.R. No. 2, dated 20th March 2014. In this connection this is bring to the notice of the Board that on physical verification of the site it is found that there is no structure in existence at present and the comprising G.L.R. Survey No. 127 is totally vacant land.

As per land policy [Cantonment Laws Vol II page No. 556 (ii) 4 revised edition] vacant land resumed in the civil area may be utilized by the Cantonment Board for their normal municipal/commercial purposes on payment of normal/commercial charges. Hence, no mutation process can be considered on the vacant land. Accordingly Board should reconsider the mutation case of Survey No. 127.

RESOLUTION

7. Considered and approved. Further Board resolved to determinate the lease under intimation PDDE, CC, Lucknow after taking legal opinion from CBLA for non mutation as well as resumption proceedings. The said land situated in prime commercial location behind Post office, Sadar Bazar and below Aashiyana Park and it can be utilized as commercial purpose i.e. shops, shopping complex, guest house purpose, garden etc. In this regard CEO informed to the Board the reclassification of the land is also required for utilization and Board unanimously resolved to reclassify the land from B-3 lease land to class ‘C’ and a proposal for reclassification of land be also forwarded to the higher authorities.

8. ISSUANCE OF CHARGE SHEET TO SHRI GOPAL RAM ARYA

Ref:- C.B.R. No. 13, dated 17-11-2011, C.B.R. No. 41, dated 20-03-2014 and C.B.R. No. 21, 30-04-2014.

It is submitted that the charge sheet framed against Shri G.R. Arya, Toll Supdt. is placed on the table for approval as the post of Toll Supdt. is a supervisory post hence Board is a competent authority to issue a charge sheet to supervisory post.

8. Considered. Further Board resolved that charge sheet be issued and if he fails to comply the charge sheet and deny to accept the charges framed against him, inquiry officer and presenting officer be appointed. Inquiry officer may be DEO, Bareilly Shri A.K. Nema and Presenting officer may be Shri D.S. Rana, Account Clerks.

9. EXEMPTION FROM PAYMENT OF VEHICLE ENTRY FEE

Reference CBR No. 10, dated 17-11-2011.

To consider the matter regarding exemption from payment of vehicle entry fee under the Indian Tolls (Army and Air Force) Act, 1901, dignitaries and vehicles engaged for essential services.

OFFICE REPORT

It has been reported by the toll employees on 1-4-2014 that the vehicles of dignitaries of Bharitiya Janata Party entered into the Cantonment through Dwarahat Road Barrier without paying vehicle entry fee. Due to lack of specific instructions regarding exemption of vehicle entry fee in respect of dignitaries and other vehicles exempted as per rule the staff deployed at the barrier is facing difficulty in realizing the vehicle entry fee.

Meanwhile two letters also received to this office vide letter No. 284/HVUS/RKT, dated April 28th, 2014 submitted by Shri H.H.B. Singh, Himalayan Vriddhjan Utthan Samiti, Ranikhet and letter dated May 06th, 2014 submitted by Principal Mount Sinai School, Mall Road, Ranikhet regarding exemption of toll tax/Vehicle Entry Fee. A letter, dated May 26th, 2014 has also been received from Samajik Karyakarta, Shri Anand Agarwal avam all vehicle owners for exemption of vehicle entry fee.

In this connection it is stated that the National Highways Fee (Determination of Rates and Collection) Rules, 2008 as amended, exempted the dignitaries and other vehicles under rule 11 as given below:-

Exemption from payment of fee. - (1) No fee shall be levied and collected from a mechanical Vehicle

(a) Transporting and accompanying–

(i) The President of India;

(ii) The Vice-President of India;

(iii) The Prime-Minister of India;

(iv) The Governor of a State;

(v) The Chief Justice of India;

(vi) The Speaker of the House of People;

(vii) The Cabinet Minister of the Union

(viii) The Chief Minister of a State;

(ix) The Judge of the Supreme Court;

(x) The Minister of State of the Union;

(xi) The Lieutenant Governor of a Union territory;

(xii) The Chief of Staff holding the rank of full General or equivalent rank;

(xiii) The Chairman of the Legislative Council of a State;

(xiv) The Speaker of the Legislative Assembly of a State;

(xv) The Chief Justice of a High Court;

(xvi) The Judge of a High Court;

(xvii) The Member of Parliament;

(xviii) The Army Commander or Vice-Chief of Army Staff and equivalent in

other services;

(xix) The Chief Secretary to a State Government within concerned State;

(xx) The Secretary to the Government of India;

(xxi) The Secretary, Council of States;

(xxii) The Secretary, House of People;

(xxiii) The Foreign dignitary on State visit;

(xxiv) The Member of Legislative Assembly of a State and the Member of Legislative Council of a State within their respective State, if he or she produces his or her identity card issued by the concerned Legislature of the State;

(xxv) The awardee of Param Vir Chakra, Ashok Chakra, Maha Vir Chakra, Kirti Chakra, Vir Chakra and Shaurya Chakra, if such awardee produces his or her photo identity card duly authenticated by the appropriate or competent authority for such award;

(b) Used for official purposes by –

(i) The Ministry of Defence including those which are eligible for exemption in accordance with the provisions of the Indian Toll (Army and Air Force) Act, 1901 and rules made thereunder, as extended to Navy also;

(ii) The Central and State armed forces in uniform including para military forces and police;

(iii) An executive Magistrate;

(iv) The fire-fighting Department or organization;

(v) The National Highways Authority of India or any other Government organization using such vehicle for inspection, survey, construction or operation of national highways and maintenance thereof;

(c) Used as ambulance; and

(d) Used as funeral van”.

Further, it is brought to the notice of Board that the vehicles of Central and State Govt. have already been exempted vide CBR No.10, dated 17-11-2011.

The Board may consider the matter accordingly.

RESOLUTION

9. Considered and Board resolved that not to provide exemption in vehicle entry fee as per three letters quoted in agenda side. Further Board resolved to waive-off the petty amount of vehicle entry fee in accordance with report dated 1-4-2014 and also to settle, if any, audit objection. The Board also resolved that the list mention in agenda site is approved for vehicle entry fee.

10. PROVIDING OF LAND FOR MAKING HI-TECH TOILETS WITHIN CANTT AREA

To consider letter No. 69/Vi.Aa./2014-15, dated May 12th, 2014, letter No. 228/2-6-662 (III)/2014-15, dated April 26th, 2014 received from Director Finance Uttarakhand Tourism Department, Dehradun & letter No. 267(Vi)/Sulabh Sauchalaya/2014, dated May 03rd, 2014 received from SDM, Ranikhet.

OFFICE REPORT

It is stated that the Director Finance Uttarakhand Tourism Department, Dehradun and SDM, Ranikhet, intimated this office as per Government Order No. 711/VI(1)/2014-02-(27) 2011, dated March 28th, 2014, Hi-Tech Toilets are sanctioned within Cantonment area and also requested to provide land for construction of Hi-Tech Toilets at following places within Cantonment area to Sulabh International, Dehradun :

  1. Taxi Stand, Ranikhet.
  2. Meena Bazar, Ranikhet,
  3. SDM Court, Ranikhet,
  4. Gandhi Chowk, Ranikhet.

It is pertinent to mention here that out of above locations, SDM Court is situated on B-2 land, which is under management of State Government.

For above locations, except Sl. No. 3, a joint survey, dated May 22nd, 2014 has been made under supervision of Shri S.R. Pathak, Asst. Controller, Sulabh International, Dehradun with Cantonment Board Officials.

It is brought the notice of the Board that as per survey report dated May 22nd, 2014, it is suggested that

(1) Taxi Stand, Ranikhet – exact location will be at the entrance of Nalah near Meat Market (Sy. No. 99/1/17),

(2) Meena Bazar, Ranikhet – exact location will be in Sy. No. 135/1 (Sloppy portion) in front of Dr. Bangari Clinic, Deolikhet below Range Quarter,

(3) SDM Court, Ranikhet – exact location will be decided by State Government authorities which will be situated on B-2 land, which is under management of State Government.

(4) Gandhi Chowk, Ranikhet – earlier fixed location has been shifted after survey and which will be near Pathak Bakery (Sy. No. 124).

The Board may consider the matter accordingly.

10. Considered and approved as per agenda. Further elected members requested to shift the location of point No. 3 in any other location in civil area. In this regard Board resolved to forward a request letter to SDM, Ranikhet for shifting of location.

11. SURVEY OF DEFENCE LANDS INSIDE AND OUTSIDE CANTT : FINALIZATION OF SURVEY REPORT

Reference Dte. DE, Central Command, Lucknow letter No. 52727/Cantt/Sy. Unit/IV, dated May 26th, 2014.

It is stated that as per above quoted letter the draft report has been scrutinized and discrepancy/omission has been intimated to DEO Bareilly and M/s WAPCOS Ltd and copy endorsed to PDDE vide this office letter No. 261/S&D/14, dated May 27th, 2014.

Hence the matter is being put up before the Board for consideration.

12. DISPOSAL OF 10 (NINE PINE AND ONE WALNUT) DANGROUS GREEN STANDING TREES

Reference Cantonment Board resolution No. 35, dated March 20th, 2013 and report of Shri P.C. Joshi, Dy. Ranger, dated May 26th, 2014.

To reconsider the matter regarding disposal of 10 (nine pine and one walnut) dangerous green standing trees.

OFFICE REPORT

As per report of of Dy. Ranger, dated May 26th, 2014, tenders were invited vide this office letter No. 218/Vraksha Nistaran/14, dated Jan 20 th, 2014. Three tenders could be received in the stipulated period, out of these three tenders, Shri S.K. Shah, Hari House, Rai Estates, Ranikhet has quoted lowest rates for the purpose. The matter was placed before the Board vide its resolution No. 35, dated March 20th, 2014 for approval of the lowest tender and Board approved the same as per agenda.

In pursuance of the Board resolution, this office informed to the contractor vide this office letter No. 218/Vraksha Nistaran/14, dated March 25 th, 2014 to deposit Rs. 2,86,885/- in this office, but no reply was received in this office. Again a reminder was issued to the contractor vide this office letter No. 218/Vraksha Nistaran/14, dated April 16th, 2014 by giving 03 days time but again no reply received in this office. Finally this office again issued a letter to the contractor vide this office letter No. 218/Vraksha Nistaran/14, dated May 05th, 2014 by giving 07 days time and also intimated that if the contract fails to deposit requisite amount in the stipulated time, tender will be cancelled and re-invited.

The Board may consider the matter accordingly.

15. PURCHASE OF BENCH SHEDS AND FLOWER POT STAND (IRON TEE)

To consider the matter regarding purchase of bench tin sheds and flower pot stand (Iron Tee).

It is stated that Dy. Ranger and Draughtsman, Cantonment Board, Ranikhet has demanded 05 bench tin sheds and 50 flower pot stand (Iron Tee) vide their application dated May 12th, 2014. Accordingly Local Purchase Committee invited quoted vide this office letter No. 133/Quotation/14, dated May 14 th, 2014. Three quotations could be received in the stipulated period. Out of three quotation M/s Kumar Steel Works, Ranikhet quoted lowest rates i.e. Rs. 9,988/- each bench tin shed inclusive all taxes and Rs. 1,110/- each flower pot stand (Iron Tee) inclusive all taxes.

The Board may consider the matter accordingly.

16. RENEWAL OF LEASE IN RESPECT OF SURVEY NUMBER 99/1/2

To consider letter No. Cantt Bd/Gen/Q(ii), dated April 15th, 2014 received from Station Headquarter, Ranikhet.

It is stated that the site comprising GLR Sy. No. 99/1/2 admeasuring 900 sqft is held in lease in Schedule VI of Cantonment Land Administration Rules, 1925 for a period of 30 years from Jan 21st, 1932. The said land is classified as B-3 and under the management of Cantonment Board. The said lease was renewed for thirty years from Jan 21st, 1962 on payment of annual rent of Rs. 6.75 in Schedule IV of Cantonment Land Administration Rules, 1937. The above lease has expired on Jan 20th, 1992. The Ex-lessee Shri Ramesh Chandra Agarwal son of Shri Suraj Mal has applied for the renewal of lease in respect of Sy. No. 99/1/2.

Shri Ramesh Chandra Agarwal has encroached upon govt land by constructing 8 RCC pillars on ground floor, 7 RCC pillars on 1st floor, RCC beam and RCC slab on northern and western sides of his house No. 817 by covering 56.29 sq.mts of Govt. land out of Survey No. 99/1 (B-4 land).

Previously the lease was renewed in favour of Shrimati Parwati w/o Shri Bhagwan Dass who has expired now issueless. The property has been transferred in the name of Shri Sham Lal Sharma being executor as well as the beneficiary of lease “Will and testament” of late Smt. Parwati Devi first then in the name of Shri Ramesh Chandra Agarwal who purchased the said property from him.

The site is meant for the purpose of residence-cum-shop as envisaged in clause 1(6) of the subsisting lease.

In the year 1992, the proposal was not involve sub-division of site, change of purpose except encroachment and unauthorized construction made without obtaining any permission from the Cantonment Board.

He has been served with notice under section 185 and 256 of the Cantonments Act, 1924 for which he has applied to the Court for temporary injunction. He has also been persecuted in the Court under section 184 of the Cantonments Act, 1924.

The case was under trial in the Court. During the pendency of the case, the lessee continued the unauthorized construction. The Hon’ble Court was approached for grant of stay so that further unauthorized construction/encroachment can be checked. The Hon’ble Court, however, adjourned for hearing the case to March 12th, 1992. Since the lessee has breached the terms and conditions of the lease, it is considered that the lease should not be renewed and lessee should be asked to hand over possession of the site to the Board.

Meanwhile, Shri Ramesh Chandra Agarwal, House owner, Shiv Mandir Road, Ranikhet has applied vide his application dated Nov 30th, 1994 for conversion of 900 sqft or 83.52 Sq. mts of land held on lease in Schedule VI of Cantonment Land Administration Rules, 1925 for a period of 30 years with effect from Jan 21st, 1963 and the lease of the subject site has expired on Jan 20th, 1992, into free hold in the terms and conditions mentioned in the Govt of India, Ministry of Defence letter No. F.11013/7/73/D(Lands) Vol. III, dated June 18th, 1982 read with letter No. 11013/7/73/D(Lands) Vol. III, dated March 26th, 1983. Shri R.C. Agarwal has also requested to purchase additional vacant B-4 land measuring 56.29 sq.mts adjacent to his leased site as per terms and conditions imposed by the Govt. The said vacant land is classified as B-4 and situated within Civil Area notified under section 43-A of Cantonments Act, 1924 and not required by the Cantonment Board for any municipal purposes.

The application of the lessee for conversion of aforesaid site into free hold was referred in the Cantonment Board for consideration and the Cantonment Board vide its resolution No. 3(1), dated July 05th, 1995 has resolved that the request of the applicant for conversion of site into free hold rights of land measuring 83.52 sq.mts comprising General Land Register Sy. No. 99/1/2 and land measuring 56.29 sq.mts out of Sy. No. 99/1 be projected to higher authorities for obtaining Govt. sanction.

The view of the LMA for grant of free hold rights has been requested vide this office letter No. 261/142/Sy. No. 99/1/2, dated Sept 04th, 1995 but the same is still awaited.

The site in question is being used for the purpose of dwelling house and shop. In the year 1995, no sub-division of site, change of purpose, beached of terms of lease involved in this case but lessee has constructed/encroached upon 56.29 sq.mts Govt. land by making RCC pillars, RCC beams, RCC projections and part of rooms.

In the year 1995, the detail of the built up area covered by the building and vacant area as verified by the technical staff of the Cantonment Board is appended below :

In the year 2014, the matter was again pursued. After scrutinizing the file, it is found that LMA View is still awaited on the issue, hence this office again requested to the Station Headquarter to forward their view on the issued vide this office letter No. 261/142/Sy. No. 99/1/2, dated March 01 st, 2014.

In reply of the above letter, Station Headquarter informed to this office vide its letter No. Cantt Bd/Gen/Q(ii), dated April 15th, 2014 that reconsider the issue of free hold rights in respect Sy. No. 99/1/2 with reference to the requirement of said Defence Land by Cantonment Board, Ranikhet in present context of development works in Ranikhet at your end.

It is pertinent to mention here that the applicant has already been deposited 25% of the estimated conversion cost of Rs. 4,723/- as per prevailing rate of STR at that time vide Cantt. Board receipt No. J-777297, dated Aug 31st, 1995.

Hence the matter is being put up before the Board for reconsideration.

Relevant file alongwith report of Draughtsman, dated April 21st, 2014 is placed on the table.

RESOLUTION

16. Considered and matter discussed at length. In this connection, elected member told that Board have already taken conversion cost i.e. 25% of the total conversion cost so process of free hold be expedited and NOC be obtained from LMA. As per Station Headquarter letter quoted in agenda side, CEO advised that if Board desires to use the said premises for municipal purpose such as group latrines, staff quarters etc, reclassification of the land from B-4 to C is required.

Further Board unanimously decided that Board has given a split verdict in this regard Board decided that LMA has full liberty to give its NOC as per their requirement.

17. LAYING OF 125 DIA RISING MAIN FROM DEVI DHUNGA PUMP HOUSE TO OLD CANTT STOCK YARD

Reference Cantonment Board resolution No. 1, dated Dec 14th, 2012 passed by circulation and confirmed vide Cantonment Board resolution No. 4, dated Jan 03rd, 2013.

OFFICE REPORT

It is stated that the matter regarding laying of 125 mm dia pipeline from Devi Dhunga Pump House to Old Cantt Stock Yard was placed before the Board vide its above quoted resolution and Board resolved that the revised estimate for Rs. 83,05,000/- for the project be forwarded to Dte. DE, Central Command, Lucknow to approach the Central Government for sanctioning Rs. 83,05,000/- under code head 094/89, object head 35 (for creation of capital assets) to Cantonment Board, Ranikhet.

Accordingly the matter was forwarded to the higher authorities for approval vide this office letter No. 12/S.P./13, dated Feb 18th, 2013. In reply of the same, Dte, DE, CC has raised an observation vide their letter No. 43376/RKT/Spl. Grant-in-aid/(2)(2011-12/LC5(p), dated Nov 20th, 2013 stating that it is observed that the project cost is Rs. 83,05,000/- whereas the estimates have been vetted by GE MES, which is beyond the competency of GE, MES and advised to get estimates vetted from the competent MES authority.

In reply of the Dte letter, this office informed to Dte, vide this office letter No. 12/S.P./13/II, dated Dec 09th, 2013 that the Executive Engineer, Construction Division, Uttarakhand Payjal Nigam (State Govt. Agency) has been vetted the estimate amounting to Rs. 83,05,000/- so this office assumed that he is a competent authority.

Dte. DE, Central Command, Lucknow again raised an objection vide their letter No. 43376/RKT/Spl. Grant-in-aid/(2)/2011-12/LC-5(p), dated Feb 20 th, 2014 stating that the Executive Engineer, Construction Division, Uttarakhand Payjal Nigam (State Government Agency) is the competent authority to vet the estimate. Hence the Government order, if any, mentioning that Executive Engineer, Construction Division is competent to vet the estimate please provide the same and if not, got it vetted from the competent MES authority and forward to them for consideration.

In this connection, this office requested to Executive Engineer, Uttarakhand Payjal Nigam, Ranikhet vide this office letter No. 116/Vetting Power/14, dated March 03rd, 2014 to provide government order regarding vetting power of Junior Engineer, Assistant Engineer, Executive Engineer & Supdt Engineer.

In reply the above letter Executive Engineer, Uttarakhand Peyjal Nigam, Ranikhet informed to this office on the same letter that the E.E. & S.E’s vetting power is Rs. 75.00 lakh & 2.00 crore respectively.

Accordingly, this office prepared an estimate for the said project amounting to Rs. 74,78,900/- so that the formality of vetting could be done at local/Ranikhet level.

It is pertinent to mention here that that matter regarding approval of the estimate amounting to Rs. 74,78,90/- was circulated vide this office letter No. 115/Circular Agenda/14, May, 2014 But during discussion with the PCB, the PCB instructed that inspite of reducing the amount old estimate Rs. 83,05,000/- will be sent to competent authority for vetting and also sent to higher authorities for approaching to the Central Government for grant-in-aid under code head 094/89, object head 35 (for creation of capital assets) to Cantonment Board, Ranikhet.

Hence the matter is being placed before the Board for appropriate decision.

18. CONSTRUCTION OF STATUE ON VARIOUS PLACES FOR BEAUTIFICATION OF CANTONMENT AREA

To consider the matter regarding construction of statue at various places for beautification of Cantonment area.

It is stated that the Cantonment Board is think over to contract many type statue at various places for beautification of Cantonment area. For this purpose places will be identified after approval of the Board.

It is brought to the notice of the Board that contractor/artist may be engaged through tender process and material will be provided by the Board to the engaged contractor.

18. Considered and approved as per agenda. Further Board resolved that the places be identified, where installation of statues (which reflect the Kumauni culture and Ranikhet) can be done and a contractor/artist also be engaged through LPC for the purpose. After engagement of the contractor/artist, material be provided for construction of statues.

19. NAMING OF VARIOUS SOCIAL INITATIVES/SCHEMES INITAITED BY RANIKHET CANTT

To consider the matter regarding naming of various social initiatives/schemes initiated by Ranikhet Cantonment Board.

It is stated that this office is making unrest effort for various social activities and new initiatives in various fields. In this regard following schemes are either started and running successfully and some are under process :

1. SWAVALAMBAN ¼LokoyEcu½- Vocational Centre (Beautician and Tailoring in Chaubattia, Ranikhet) for women empowerment.

2. SARTHAK ¼lkFkZd½ - Centre for differently abled children in Cantonment Inter College, Sadar Bazar premises, which is under process.

3. VANPRASTHA ¼okuizLFk½ - A day care centre for old age persons and senior citizens, which is under process.

4. JIGYASA ¼ftKklk½ - Centre for unemployed youth regarding self study and carrier guideline in Cantonment Library Premises, which is under process.

5. SWABHIMAAN ¼LokfHkeku½ - Scheme for Cantonment Fund Group ‘D’ Employee’s family to provided vocational training to make them self respective and self dependent.

6. SMRITI VAN ¼Le`fr ou½ - Some places identified by this office to establish Smriti Van (memorial place) through tree plantation. The tree will be planted by the interested persons/school students/organization/officials etc in the memory of any person/organization etc with a small bench and tree guard (optional).

Presently this Board will develop the sites as a Smriti Van, where interested persons can planted saplings in the memory of any person.

This scheme will not only increase the greenery in Cantonment but also prevent the encroachment and unauthorized occupation. It could be developed as an ideal Eco-friendly tourist place as well as garden.

RESOLUTION

19. Considered and Board appreciated the steps taken by the CEO for naming of the various schemes, which are running successfully or either under process in social service field.

Further Board resolved that SWAVLAMBAN is a good scheme/centre and it should be extended in other remote areas in Cantonment Limit. In this regard required staff be appointed through outsourcing agency.

Further Board resolved that if any applicant agreed to reside in Ranikhet and provide his service for SARTHAK Center, a room in Centre be provided alongwith Rs. 8,000/- honorarium.

Further Board resolved that for VANPRATHA Scheme/Centre Board can use Group “D” Cantonment Employees Union’s Office as a day care centre for old age persons.

Further Board resolved to start the center namely JIGYASA, teachers/instructors be appointed on honorarium basis for Math, English, Reasoning and General Studies.

Further Board resolved that SWABHIMAAN scheme should be free of cost and extended to not only Group “D” permanent employees as well as temporary Group “D” employees.

Further Board unanimously resolved that for SMRITI VAN (memorial place), three places i.e. near Diwan Singh Hall, near Mint Spring and at Mall Road, are being identified for establishment of SMRITI VAN (memorial place) through tree plantation.

Further Board resolved to expedite the above proposals.

20. SUPPLY OF X-RAY MACHINE AND SEMI-AUTO ANALYSER FOR CANTT DISPENSARY RANIKHET.

To consider the matter supply of x-ray machine and semi-auto analyser for Cantt Dispensary Ranikhet.

Limited tender/quotations were invited for the supply of X-Ray Machine for Cantonment Dispensary vide this office letter No. 191/Vigyapti/14, dated 17 th May, 2014. No quotations were obtained by this office in the stipulated period. One Semi-Auto Analyser is also required for better health facilities and smooth functioning of Cantt Board Pathology Lab. The approximate cost of X-Ray Machine (100 M.A. Capacity) is Rs. 2 Lakh to 2.50 Lakh and the approximate cost of Semi-Auto Analyser is Rs. 1.70 Lakh to 1.80 Lakh. Budget provision will be made for the financial year 2014-15(R) regarding purchase of X-Ray Machine and Semi-Auto Analyser.

The board may consider the matter accordingly.

20. Considered and Board resolved that the required x-ray machine and semi-auto analyser for Cantt Dispensary Ranikhet be purchased through LPC under intimation to the PDDE, CC, Lucknow, as the said amount is under 5 lakh.

21. PAYMENT AGAINST INSTALLATION OF ELECTRIC POLES AND LAYING OF PIPE LINE

To consider the C.B.R. No.39, dated 17-10-2011for Shri Vikram Singh Cantonment Board, Ranikhet for pending payment against the subject work.

As per work order No. 116/WO/ADM, dated 9-02-2010 it was ordered to contractor Shri Vikram Singh to execute the work namely “electric poles supply and grouting total wards amounting to Rs. 20,000/- and work order No.116/WO/ADM, dated 26-10-2009 it was ordered to contractor to execute the work namely “other supply work (ward No. 1,3,4,5,6 & 7)”. The estimated cost of same work was 7,00,000/-.

Above mentioned both works had been executed by contractor but some measurement could not take in to account due to over sight/routine work load on engineering section. The work in question so executed has been certified by the JE and Draughtsman of this Office.

The board may consider the matter as requested by the contractor subject to restrict the payment Rs. 1,03,664/-, which is calculated by JE.

RESOLUTION

22. Considered and Board discussed the agenda point at length and CEO informed the Board that at present Board is bearing a quantum of loss in water supply/distribution and also stated that as per DGDE direction no profit not loss basis should be opt as Ranikhet Cantonment Board is a deficit Board. Further CEO stated in respect of arrears of MES water connections that some consumers have been deposited their water bills i.e. 25% approx and 75% consumers have not deposited their bill.

Further Board resolved that in respect of MES connections, consumers are not depositing their bill/arrears and Board is bearing loss. So Board will again efforts for recovery of at least 50% of arrear i.e. 50% amount will be recover from 75% consumers, who have not paid the arrears.

Further Board resolved to sent a proposal to PDDE, CC, Lucknow for waive-out the 50% amount i.e. approx 14.50 lakh of whole arrears as on May 31 st, 2014. As per section 115 of Cantonments Act, 2006, “ the Board may write off any sum due on account of any tax or rate or of the costs of recovering any tax or rate if such sum is, in its opinion, irrecoverable:

Provided that, where the sum written off in favour of any one person exceeds two thousand and five hundred reupees, the sanction of the General Officer-Commanding-in-Chief, the Command shall be first obtained”. After getting approval from PDDE, Board will adjust the 50% amount for those consumers, who have already paid 100% arrears. If PDDE has not waive-off 50% amount of the arrear, the Board will recover 100% amount of arrear.

Further Board resolved that wherever both connections are existing (MES and independent water supply scheme of Cantonment Board), Board will replace the MES connection by providing water connection form independent water supply scheme of Cantonment Board. If any consumer desires to continue MES connection, they will pay as per MES bill.

Further Board resolved, keeping in view of pending water connection and limited source of water.

Board will not provide more than 3 connections in each household. For domestic purpose – 1st connection will be provided on domestic rates and rest will be on special rates and for commercial purpose quota has been fixed @ 3 connections maximum.

Further Board resolved that Board have already approved the previous suggestions so Board have responsibility to provide pending water connections on priority basis and priority will be given to those consumer, who have no any connection and they comes under – widow, senior citizens and disabled.

It is stated that at present Cantonment Board shop No. 188-T allotted to Shri Shaif Ali S/0 Mohd Idris. Shri Shekhu Iliyas s/o Mohd Iliyas who is cousin brother of the present occupier i.e. Shri Shaif Ali S/0 Mohd Idris is requesting that the said shop be transferre in his name. In this connection Shri Shaif Ali S/0 Mohd Idrish has produced an affidavit dated 11th December,2013 in favour of Shri Shekhu Iliyas that the licence of said shop be transfer in the name of Shri Shekhu Iliyas.

As per the terms of present contract for parking fee collection right is to be expired on 31st March, 2014. In this regard tenders were invited vide this office letter No. 154/Parking Dated 20th February 2014, by publishing in daily news paper Danik Jagran, Amar Ujala, on 21th Feb 2014 respectively. Three tenders could be received by this office within the stipulated period, among which the highest bid has been offered by Shri. CANTONMENT BOARD RESOLUTION NO. 14, DTAED 20-03-2014

27. RENEWAL OF OCCUPANCY RIGHT OF CANTONMENT BOARD SHOPS/STALLS/ KIOSKS ON CLASS ‘C’ LAND

To consider the matter regarding renewal of occupancy rights of shops/stalls/kiosks for a period of 364 days w.e.f. 01st April, 2014 on payment of stallage fee/licence fee.

OFFICE REPORT

It is stated that the Cantonment Board is running 115 Nos of shops/stalls/kiosks on class ‘C’ land. The practice is to give occupancy rights of shops/stalls/kiosks under rule 8 of the Cantonment Property Rules, 1925 under rule 39 of Cantonment Land Administration Rules, 1937 for 364 days renewed each year on payment of stallage fee as fixed by the Board from time to time. The process was in practice for a long time. As per the provision of section 267 of Cantt Act, 2006 the Board is required to obtain the sanction of the Goc-in-chief of the command or the Principal Director before allotting occupancy rights without public auction.

Previously the Board vide its resolution No. 37, dated 12th December, 2013 resolved that “ Considered and decided that ehe shop in question be allotted for 11 months on payment of licence fee and premium by enhancing the licence fee in the following manner:

i) Upto 7,000/- - by increasing 15%

ii) above 7,000/- - by increasing 10%

iii) Willingness of interested lessee be obtained upto 31 January, 2014 for the year 2013-14 for obtaining ex-post facto sanction from PDDE.

iv) Willingness of interested lessee be obtained upto 31 January, 2014 for the year 2014-15 for obtaining sanction from PDDE.

v) A detailed Survey be made by Revenue ection with the help of other concerned sections on time bound manner upto 31 January, 2014 regarding survey of used, unused, closed, authorized, unauthorized, dilapidated shops, proposed location for new shops & all type of kacha, pakka, nature of business and location etc. (with area).

vi) After detailed survey, the fee will be calculated on the basis of current STR.

Survey report will be put up before the Board for consideration. Finally a consolidated policy be framed, which will be adopted to leased out the Cantonment shops.

As per above directions given by the Board this office has issues bills of all concerned shopkeepers and a detailed survey is in progress. As per the current status approx 90 shopkeepers are submitted their willingness for the year 2014-15. It is also submitted that the total 6 stalls is found closed within cantonment area.

The matter was placed before the Board and Board resolved that a proposal be forwarded to PDDE, CC, Lucknow for obtaining ex-post-facto sanction for the year 2013-2014 and prior approval for the financial year 2014-2015. Decision of six closed stalls pended due to enforcement of code of conduct for Lok Sabha Election, 2014. Further the Board decided that the Board will not take premium from the Shopkeepers as per section 267 of Cantonments Act, 2006.

To consider the matter regarding A.M.C. of Photostat-cum-Printer (Ricoh) and various electronic equipments such as Computer, printer, fax, scanner, projectors, ups, telephones etc.).

OFFICE REPORT

It is bring to the notice of the Board that the Local Purchase Committee, Cantt Board, Ranikhet has done a survey on 29-01-2014 regarding A.M.C. of RICOH Photostats Machine. As per report of Local Purchase Committee the lowest rates i.e. Rs. 12,000/- per annum has been found by M/s Daksh Enterprises, Shop No. 62, K.M.V.N. Complex, Haldwani. In this connection, this office has already been done A.M.C. with M/s Daksh Enterprises, Shop No. 62, K.M.V.N. Complex, Haldwani for RICOH Photostats Machine.

It is pertinent to mention here that this office have many other electronic equipments such as Computer, printer, fax, scanner, projectors, ups, telephones etc, which are also needed A.M.C.

Hence the matter was put up before the Board for noting in respect of A.M.C. of RICOH Photostats Machine and further issue necessary direction of A.M.C. of other said electronic equipments.

The matter was placed before the Board and Board resolved that Board noted and approved the A.M.C of RICOH Photostat Machine and further decided that the rest of A.M.Cs of other electronic/electrical/mechanical equipments should be done after end of code of conduct for Lok Sabha Election, 2014.

29. RECOGNITION OF CANTONMENT BOARD EMPLOYEES UNION

Reference DGDE letter No. 25/37/JCM/DE/2011, dated Jan 17th, 2012, even number dated July 26th, 2013 and even number dated Aug 26 th, 2013.

To consider the matter regarding recognition of employees union in Ranikhet Cantonment Board.

OFFICE REPORT

As per the higher authorities directions vide their letter quoted above regarding recognition of employees union. The Cantonment Board has write a letter to both unions, who presently working in Cantonment Board namely Cantonment Safai Karamchari Avam Chathurth Shreni Union and Kumaon Mandal Cantonment Board Chathurth Shreni Ekta Parishad to complete all formalities and submit all required documents for further action in this matter

After that Kumaon Mandal Cantonment Board Chathurth Shreni Ekta Parishad has submitted an application with all required documents such as Memorandum of Union, Constitution and Bye-laws of Union and also registration certificate issued by the Registrar, Trade Union, Uttarakhand, Haldwani, Distt- Nainital with 107 (one hundred seven) members signature list etc.

In this connection, Cantonment Safai Karamchari Avam Chathurth Shreni Union was applied for registrated their union in the office of the Labour Commissioner/Registrar, Trade Unions, Uttarakhand, Haldwani, Distt- Nainital but the Labour Commissioner/Registrar, Trade Unions, Uttarakhand, Haldwani, Distt- Nainital was rejected union’s application vide their letter No. 4727@ VªsM ;wfu;u ¼eq0½ &14&344@2013, dated Nov 12th, 2013 .

As per report dated Jan 22nd, 2014 received from Sanitary Inspector, Cantonment Board, Ranikhet, Kumaon Mandal Cantonment Board Chathurth Shreni Ekta Parishad has submitted all documents as per required vide DGDE letter quoted above and also submitted a list of 107 member, which are supported to the union. Out of 107 member, the physical verification of 85 member has been done before the competent authority.

The directions laid down in DGDE letter that “ the Association represents minimum 35 percent of total number of a category employees provided that where there is only one Association which commands more than 35 percent membership, another Association which second highest membership, although less than 35 percent may be recognized if it commands at least 15 percent membership.”

Presently 157 group ‘D’ permanent employees are working with the Board and Kumaon Mandal Cantonment Board Chathurth Shreni Ekta Parishad has submitted the list of 107 members but after verification of membership of union through check off system, which is done by the CEO, only 85 members are found valid i.e 54%. As per DGDE letter quoted above, it is more than 35% (which is sufficient for recognition of union).

It is also pertinent to mention here that Cantonment Safai Karamchari Avam Chathurth Shreni Union has also affiliated with All India Cantonment Employees Federation, Faridabad (Hariyana) and the said association i.e. All India Cantonment Employees Federation, Faridabad (Hariyana) has also recognized by the Government of India, Ministry of Defence.

Further it is brought to the notice of the Board that an employee cannot be participated in Cantt Board union’s election, who’s service record is blemished & if, charges have been proved & penalized.

The matter was placed before the Board and Board resolved that the matter be pended due to enforcement of code of conduct for Lok Sabha Election, 2014.

29. Considered and matter discussed at length. Further Board resolved that Board is principally agreed to recognize the union/unions. In this regard Board have already resolved in earlier Board meeting that a letter be issued to (i) Cantt Safai Karmchari and Chaturth Shreni Union for obtaining registration from Labour Commissioner Office, Haldwani; (ii) Kumaon Mandal Cantt Board Chaturth Shreni Karmchari Ekta Parishad for taking affiliation from All India Cantt Board Federation. (iii) Reasons for not conducting of Local JCM be intimated to Principle Director, Central Command, Lucknow and take necessary advice in this regard” .

The CEO informed to the Board that in pursuance of the resolution, both unions have been informed vide this office letter No. 121/ADM/JCM/14, dated May 08 th, 2014 but it is pertinent to mention here that Kumaon Mandal Cantt Board Chaturth Shreni Karmchari Ekta Parishad is fulfilling all the requirement as per DGDE’s letter.

Further Board finally resolved that the recognition of the union and holding of JCM meeting is interrelated matter, hence advice be obtained from PDDE, Central Command, Lucknow for recognition of those union, which is not affiliated with All India Cantonment Board Employees Federation, but fulfilling all the requirements as DGDE’s letter and Cantonment Laws.

CANTONMENT BOARD RESOLUTION NO. 27, DTAED 20-03-2014

30. SURVEY OF AUTHORIZED AND UNAUTHORIZED PIGGERIES FROM RESIDENTIAL AREA

Reference Cantonment Board Resolution No. 66, dated 12-12-2013.

To consider the survey report of Sanitary Inspector regarding survey of authorized and unauthorized piggeries in Cantt area.

OFFICE REPORT

It is stated that the above referred Cantt Board resolution the board has decided that “That a survey be done through Sanitary Section regarding authorized and unauthorized piggeries in residential area so that a suitable place be selected to rehabilitate them and outcome of the survey will be put up in the next board meeting”.

A survey has been done by Sanitary Section of Cantt area and survey report has been submitted by Sanitary Inspector. As per report of Sanitary Inspector, dated Feb 18th, 2014 the all piggeries are unauthorized and mostly situated in residential area.

It is pertinent to mention here that a combined survey including Sanitation and Engineering section for rehabilitation of piggeries has been done on Feb 21 st, 2014. As per survey report, dated Feb 21st, 2014, there is no alternative place is available for rehabilitation of piggeries.

31. RECONSIDER THE MATTER FOR ENGAGEMENT OF OUTSOURCING AGENCY

Reference Cantt Board Resolution no. 67, dated 12-12-2013

To consider the matter for engagement of outsourcing agency.

OFFICE REPORT

It is stated that the matter regarding engagement of outsourcing agency was placed before the Board vide its above quoted resolution and the Board approved the L1. Further the Board discussed the matter and decided that though the L1 is too low to run the issue, however, he may be directed to execute necessary agreement in this regard. If he fails to execute the agreement, the tenders be re-invited for the purpose.

Accordingly, this office has asked to the L1 i.e. M/s Prakash B.P.O. Ramnagar to deposit EMD amount Rs. 50,000/- with his willingness to do this work vide this office letter 121/Outsourcing, dated Dec 26th, 2013 and M/s Prakash B.P.O. Ramnagar has also deposited EMD amount i.e. Rs. 50,000/- through draft No. 271093, dated Dec 13th, 2013 with his willingness vide his letter dated Jan 13th, 2014.

Meanwhile, it came to the notice of this office, M/s Prakash B.P.O. Ramnagar (L1 contractor) had blacklisted by the President, Almora Dugdha Sangh, Pataldevi, Almora.

To clarify the matter regarding blacklisting of the M/s Prakash, B.P.O., Ramnager, this office has asked to President, Almora Dugdha Sangh, Pataldevi, Almora vide this office letter No. 116/Outsourcing/13, dated 18-01-2014 and the Chief Manager, Dugdha Sangh Almora has intimated to this office vide his letter No. No. 4572/Contract Patra/2013-14, dated 20-01-2014 stating that the M/s Prakash B.P.O., Ramnagar has black listed due to non-payment of wages to contract employees.

Simultaneously, this office has asked to M/s Prakash B.P.O. Ramnagar regarding clarification on black listing vide this office letter No. 177/Out./14, dated March 07th, 2014 through mail and also by speed post but the reply is still awaited.

The matter was placed before the Board and Board unanimously decided that not to award the contract to Mr. Prakash BPO, Ramnager because he is blacklisted by the President, Almora, Dugdha Sangh, Pataldevi, Almora and refund his EMD Rs. 50,000/-. Board cannot go for re-tendering right now due to enforcement of code of conduct for Lok Sabha Election 2014, till then this office will approach to existing contractor i.e. M/s WHIZKID for continuing his service.

32. RE-FIXATION OF RATE & QUANTITY OF FIRE WOOD FOR CREMATION GROUND

To consider the matter regarding re-fixation of rate and quantity of fire wood for cremation ground.

OFFICE REPORT

It is stated that presently the Cantonment Board is providing fire wood at cremation ground @ Rs. 180/- per quintal and the Board is also paying Rs. 185/- per quintal for cutting, carriaging and transporting, hence the Board is bearing Rs. 5/- per quintal loss on its own level.

It is pertinent to mention here that the Cantonment Board, Ranikhet is a State aided Board and the higher authorities are also instructing from time to time to reduce expenditure and increase income so that the Board can become self depend Board.

In this connection, it is suggested that the rate of fire wood for cremation ground be revised as follows :

Rs. 180/- per quintal upto 7 quintal fire wood and above 7 quintal it should be provided on domestic rates i.e. Rs. 300/- per quintal + sale tax @ 5% of total exceeded amount.

In this regarding CEO advised the Board that the fire wood can be provided to the persons for cremation on no profit and no loss basis but Board unanimously decided that the fire wood be provided on Rs. 200/- per quintal for cremation purpose.

33. REGARDING WATER CONNECTION

Reference Cantonment Board resolution No. 14, dated Dec 12th, 2013.

To consider report of Work Supervisor, dated Dec 24th, 2013.

OFFICE REPORT

It is submitted that Cantonment Board Office shifted water connection of Shri D.P. Tiwari, Ex- Accountant during his service period from Old Dispensary (staff quarter allotted to him) to Badri View on his request dated Jan 15th, 2005 on medical ground, which is his present residence. Shri D.P. Tiwari was retired from his service on July 31St, 2009, but presently the water connection is stand on his residence at Badri View. In this issue CEO has sanction to disconnect the water connection of Shri D.P. Tiwari as per report of temporary Junior Engineer produced in the month of Dec, 2006, but the water connection could not disconnected till date. Shri D.P. Tiwari float an application dated Nov 27th, 2012 stating that after retirement of his father the water connection had allotted to him at his staff quarter near old dispensary and on medical ground the connection was shifted from staff quarter to his residence at Badri View and Shri D.P. Tiwari has intimated to this office that he had also paid all fee/charges to this office for the purpose but he did not submit any document regarding payment of fee/charges for the purpose. At present they have four connections except the connections shifted from staff quarter.

Earlier the matter regarding disconnection of water connection shifted from old dispensary staff quarter to Badri View at residence of Shri D.P Tiwari was placed before the Board vide its resolution No. 14, dated Dec 12th, 2013 and the Board resolved thatif any procedural laps in providing water connection, the said connection be disconnected. In case of no any laps in the procedure, connection charges i.e. Rs. 2,500/- be recovered from Shri D.P. Tiwari to regularize the issue. If the connection charges not paid by Shri D.P. Tiwari, the water connection be disconnected.

Accordingly, the Work Supervisor scrutinized the documents and found that in the report of Junior Engineer, Cantonment Board, Ranikhet, dated March 05 th, 2005, it is not clear that the said connection can be disconnected by the office or not after retirement of Shri D.P. Tiwari.

The matter was placed before the Board and Board resolved that the matter be pended due to enforcement of code of conduct for Lok Sabha Election, 2014.

Hence the matter is being put up before the Board for consideration.

It is stated that many persons were applied since last 05 years to provide private water connection to them. Due to scarcity of drinking water the matter was placed before the Board vide its resolution No. 27, dated Jan 11th, 2012 and the Board resolved that the remaining 43 water connections be released within three months period. Shir Harish Chandra Sharma was also included in the list of 43 persons (prepared by the PWD Section).

Shri Harish Chandra Sharma informed to this office vide their application dated Nov 03rd, 2012 that he had deposited Rs. 2,750/- on May 06 th, 2008 to this office to provide private water connection at his residence situated at Zaruri Bazar but till date the private water connection is not provided to him.

In this connection, this office has asked to the applicant vide this office letter No. 246/ADM, dated Nov 30th, 2011 that presently how much private water connections are exist in his house and the applicant has committed vide his application dated Dec 02nd, 2011 that presently he has two water connection in his house.

Accordingly the matter was placed before the Board vide this resolution No. 30, dated March 03rd, 2012 and the Board resolved that two water connections have already been issued to him so the 03rd water connection will be released only after Board provided at least one connection to all the needy persons.

In this connection, Shri Harish Chandra Sharma has requested to this office vide his application dated Dec 12th, 2013 stating that he had deposited requisite amount to Cantonment Board in the year 2008 but the private water connection could not be installed at his residence.

The matter was placed before the Board and Board resolved that the matter be pended due to enforcement of code of conduct for Lok Sabha Election, 2014.

36. REQUEST OF TAXI UNIONS REGARDING VEHICLE ENTRY FEE

Ref:- CBR No. 53, dated 12.12.2013.

To consider the joint application dated 21.01.2014 received from Taxi Malik ChaalakSevaSamiti, near SubhashChowk, Ranikhet and Jeep Maalik Chaalak Welfare society, Deolikhet, Ranikhet regarding imposition of vehicle entry fee once in a day in respect of vehicles registered with their unions.

OFFICE REPORT

It is stated that the request of Taxi MaalikChaalakSevaSamiti, near SubhashChowk, Ranikhet and Jeep MaalikChaalak Welfare society, Deolikhet, Ranikhet vide their joint application dated 21.10.2013 regarding reduction of vehicle entry fee was placed before the Board in its meeting held on 12.12.2013. The Board vide its resolution No. 53, dated 12.12.2013 decided that keeping in view of several agitations/representation as well as pressure from elected members, Rs. 5/- be reduced only for those vehicles which are registered with taxi union. A specific sticker/logo will be provided by the Board on payment of Rs. 50/- per sticker/logo (valid for one year) so such vehicles be indentified easily. The reduced rate is valid for six month on trail basis. Revised rates will be applicable from Jan 01st, 2014.

In pursuance of above resolution, this office vide its letter No.243/Va.Pra.Shu./13, dated 19th Dec, 2013, the Taxi unions were asked to submit list of vehicles enrolled/registered with their unions to enable this office to proceed further in the matter. But the unions didn’t submit list of vehicles and further an application dated 21-01-2014 regarding imposition of vehicle entry fee once in a day in respect of vehicles registered with their unions submitted to this office. The unions are stating that there is a small scale of taxi business in Ranikhet Cantonment and the vehicle entry fee for each entry is beyond the means of taxi business. The Unions have also requested this office to abolish the Upper Mall Permit fee.

Regarding Transit Pass

The Taxi unions have also requested to abolish the transit pass system, as Ranikhet Cantonment is business centre of surrounding villages and most of passengers travel for Ranikhet Cantonment. In this connection this office vide letter No.243/Va.Pra.Shu./2, dated 14th Feb, 2014 requested the Executive Officer, Municipal Board, Nainital to make available the Bye-laws and information regarding Vehicle Entry fee & transit fee system in respect of Mall Road Lake Bridge entry fee and Bara Patthar entry points. The Municipal Board, Nainital vide their letter No. Memo/Vividh, dated 20-02-2014 provided the Bye-laws as required. On perusal of the same it has been observed that provision for issuing of the transit pass is silent in Nainital. It is also brought to the notice of the Board that provision of issuing of the transit pass is also silent in u/s 67(e) of Cantonments Act, 2006.

The matter was placed before the Board and Board resolved that the matter be pended due to enforcement of code of conduct for Lok Sabha Election, 2014.

The Board may consider the matter keeping in view the feasibility of the issue.

A number of development project are proposed to be under taken by office as such multi-storey parking Gust House, Dam for water logged area, Stadium etc. for initiating the procedure to undertake the development project, it is felt necessary to type design plans & estimates of the project at the initial stage. In this regard it is proposed to engage a qualified Architect/ consultant on contract basis for preparation of D.P.R. of the project. Tender were invited for the execution of maintenance work under D-2 head for the year 2013-14 vide this office notice No. 116/ADM/14, dated 06-01-2014. Tender were received for the maintenance work under head, D-2(a), D-2(f). The details of tenders are as under.

It is pertinent to mention here that due to enforcement of code of conduct for Lok Sabha, 2014, tenders could not be invited by this office.

The matter was placed before the Board and Board resolved that necessary supply of wood in cremation ground could be done from Sadar tal and after completion of code of conduct for Lok Sabha, 2014, tenders will be re invited and revision of fee regarding fire wood rate will be decided after the completion of code of conduct.

46. The Board unanimously resolved to express its deep sense of gratitude to all Board members of Cantonment Board, Ranikhet for their valuable services. We all join to wish all members of the Board for happiness and prosperity in their life.

NOTE : PCB is hereby invited to all members of the Board on June 04th , 2014 for farewell party at Cantonment Guest house, Ranikhet. In this connection, PCB has authorized to CEO to incur the petty expenditures in this regard.
