RESOLUTION

01. The oath of allegiance was taken by Brig. G.S. Rathore, as President of Cantonment Board, Ranikhet.

02. IMPLEMENTATION OF PREVIOUS BOARD RESOLUTION DATED 26th May, 2018

The implementation of the board resolution passed by the board on 26 th May, 2018 is under progress.

RESOLUTION

02. Considered and noted. It was reiterated by the Vice President that quality of maintenance works be maintained at a satisfactory level. The PCB advised the CEO to check the quality of all works being carried out under D2 head. The CEO assured that highest quality of work shall be ensured.

03. CIVIL AREA COMMITTEE

To consider the minutes of Civil Area Committee meeting held on 3 rd July 2018 and the resolution passed by the committee are placed before the board for approval.

The list of points is as under:-

1. Mutation in respect of Sy. No. 99/288 (near roadways station)

2. Renovation of dilapidated buildings (Sy. No. 99/90 Smt. Janki Bisht)

3. Review of sanitary conditions in Cantonment area.

4. Reclassification of Land from B-4 To ‘C’ Land

RESOLUTION

03. Considered, noted and confirmed. The cattle menace issue was discussed at length and it was decided that the Cantonment Board will made efforts to relocate the animals to Radhey Krishna Gau Sewa Sadan, Bazpur gradually. Shri Mohan Negi, Vice President informed the board that some people in market are ready to provide vehicle and fund in charity to get rid of cattle menace. The PCB advised the CEO to contact such vehicle owners through the Vice President for the same.

04. FINANCE COMMITTEE

To consider the minutes of Finance Committee meeting held on 3rd July 2018 and the resolution passed by the committee are placed before the board for approval.

RESOLUTION

04. Considered noted and confirmed.

The point No. 9 regarding enhancement of pay of contract teachers deferred to the ensuing board meeting for more clarification regarding State Govt GOs for honorarium of contract teachers. The PCB suggested that the board has to approach to State Govt. for necessary grant for teachers through outsourcing. The PCB added that he will also approach to State Govt. authority in this regard.

The point No. 14 Col. S. Shorot brought to the notice of the board that since free uniforms, books and other stationery items are provided by the Cantt Board to all students of school, it should be checked that the parents of these students do not claim CEA. It was decided that the certificates issued by the school shall add this note that CEA will not be applicable.

05. MINUTES OF SCHOOL MANAGEMENT COMMITTEE

CANTONMENT PRIMARY SCHOOL, SADAR BAZAR, RANIKHET

1. To construct one new class room.

2. To construct one covered room (Bhojan Kaksha) for students.

3. To purchase Board Marker and Pen Drive from School Fund.

Cantonment PRIMARY School, Chaubattia

1. To replace the old computer with new one.

2. To repair roof water drain of School.

3. To repair the Aqua Guard of School.

4. To repair and whitewash of kitchen of school.

5. To provide one full time teacher.

1. To provide water and electric connection in kitchen of School.

05. Considered and board resolved that the feasibility be checked by the all concerned sections against the recommendation of SMC. Based on their report, action shall be ensured by the office.

In this connection this is bring to the notice of board that Cantt Board has engaged two advocates in Hon’ble High Court i.e. one Junior Counsel and one Senior Counsel since more than 10 years for defending the cases on behalf of Cantt Baord. Inspite of following Rules/Regulations, above counsels are unable to defend the cases strongly, because of which Cantt Board has lost several cases.

The board has also engaged Legal Advisor for defending the cases before lower courts on behalf of Cantt Board. For which Rs. 4000/- is being paid to him. The office is regularly obtaining legal advice in various matters and no extra fee is being paid to him for legal advice. But Rs. 5000/- to Rs. 10000/- is being paid to Jr. Counsel and Sr. Counsel of Hon’ble High Court of Uttarakhand for obtaining legal advice.

Hence the matter is placed before the board for reviewing the panel of counsels in High Court.

07. Considered and board unanimously declined to engage Integra Legal Panel due to higher rates quoted in the application. Further board resolved to engage a special advocate in any special case if needed.

8. ENHANCEMENT OF HONORARIUM OF CBLA, COURT’S APPEARING FEE AND OTHER EXPENSES.

To consider the letter from the CBLA dated 09th May 2018.

It is submitted that the CBLA vide his application quoted under reference has stated that he has to spend enough time in drafting legal opinions of different matters of the board in which exhausted time spends. But no remuneration is fixed by the board for this purpose. Therefore, the CBLA has requested that the remuneration of Rs. 1000/- in each opinion may be fixed for legal opinions. He has also requested to increase the honorarium from Rs. 4000/- per month to Rs. 8000/- per month and also the amount of Steno expenses from Rs. 1000/- to Rs. 3000/- as amount is quite petty in view of the present increasing dearness.

As the official work is increasing day by day, therefore each and every document/file is sent to the CBLA for obtaining written legal advice in various matters such as mutation cases, lease cases, unauthorized construction, encroachment, draft agreement, vetting of tender notice, court matters, taxes, licence fees etc.

In this connection the matter was placed before the board and board vide its resolution No. 10, dated 26th May, 2018 deferred the agenda for next board meeting.

Hence the matter is again placed before the board for consideration keeping in view the workload being provided to the CBLA by Cantt Board Office regularly.

It is submitted that as per Uttarakhand G.O. No 589/xxvii (7)40(ix)/2011, dated 01-07-2013, ACP is applicable on completion of 10, 16 & 26 yrs of satisfactory service w.e.f. 01-09-2008. As per the above G.O. para 1(c) it is clear that on completion of 10 years of service on the second promotion post or 26 years of service which ever will be earlier, the 3rd ACP will be given on that date. According to the above G.O. Shri Gopal Ram Arya, Toll Supdt, Cantt Board, Ranikhet has been completed more than 10 years of satisfactory service on the Post of Toll Supdt, hence he is entitled to grant of 3rd ACP.

Reference: - HQ, CC, Lucknow letter No 34238/GEN/LC6, dated 21 Dec 2001.

It is submitted that directions have been received from the PDDE, CC, Lucknow vide their letter No PC-34238/Ranikhet/GP-D/14(986), dated 03 Feb 2015 and 34238/RKT/GP-C (07)/16(C-496), Dated 30 Nov 2016 for providing of selection grade/ACP to the eligible Cantt. Fund employees on completion of 14 & 24 years service before 31st Aug 2008 at the Board level. Sanction from the PDDE, HQ,CC, Lucknow has already been received vide their letter No. 34238/GEN/LC6, dated 21 Dec 2001 in accordance with the U.P. Government order No VA-2-560/Das-45(M)-99, dated 02 Dec 2000 and Uttaranchal Government order No 1014/01/foRr/2001, dated 12 Mar 2001.

It is clearly mentioned in the above letter of PDDE,CC, Lucknow that the proposal for 3rd ACP are to be forwarded to PDDE,CC Lucknow after providing the benefits of 14 & 24 yrs selection grade/ACP at Board level to the eligible Cantt. Board employees.

It is pertinent to mention here that as per para 2(1) of Uttarakhand G.O. No 872/xxvii(7)u0izfr0/2011, dated 08 Mar 2011 it is clearly mention that the benefits of 14 &24 years selection grade are to be given up to 31-08-2008 and the ACP will be applicable after 01-09-2008.

It is submitted that direction have been received from the PDDE, CC, Lucknow vide their letter No PC-34238/Ranikhet/GP-D/14(986), dated 03 Feb 2015 and 34238/RKT/GP-C (07)/16(C-496), Dated 30 Nov 2016 for providing of selection grade/ACP to the eligible Cantt. Fund employees on completion of 14 & 24 years service before 31st Aug 2008 at the Board level. Sanction from the PDDE, HQ,CC, Lucknow has alredy been received vide their letter No. 34238/GEN/LC6, dated 21 Dec 2001 in accordance with the U.P. Government order No VA-2-560/Das-45(M)-99, dated 02 Dec 2000 and Uttaranchal Government order No 1014/01/foRr/2001, dated 12 Mar 2001.

It is clearly mentioned in the above PDDE,CC, Lucknow letter that the proposals for 3rd ACP are to be forwarded to PDDE,CC Lucknow after providing the benefits of 14 & 24 yrs selection grade/ACP at Board level to the eligible Cantt. Board employees.

It is further submitted that as per para 2 of Uttarakhand G.O. No 1018/x-1-2008-4(35)/2001, dated 20 Nov 2008 it is clearly mention that the benefits of 14 &24 years selection grade to the Forest Guard are to be given up to 31-08-2008 and the ACP will be applicable after 01-09-2008.

It is pertinent to mention that in accordance to the Uttarakhand G.O. No 1018/x-1-2008-4(35)/2001, dated 20 Nov 2008 and decision of Hon’ble High Court, Nainital Uttarakhand dated 23-04-2008 against writ petition No. 46/A.S/2008 it has been ordered that Forest Guard shall be paid first promotional pay scale of Rs 4000-6000, on completion of 14 years of regular service and second promotional pay scale of Rs 5000-8000, on completion of 24 years of regular satisfactory service.

It is submitted that this office has approached to Chief Development Officer, Almora for providing of fund of Rs. 1 Lakh from MLA fund to organize Ranikhet Utsav from 21st June to 23rd June, 2018 vide this office letter No. 237/Ranikhet Utsav/Dak, dated 13 th June, 2018. In response the CDO, Almora has released Rs. 1 Lakh from MLA fund to Cantonment Board, Ranikhet on 19th June, 2018.

After that a letter is received from Chief Development Officer, Almora vide their letter No. 1424/fo0fu0&jkuh[ksr@2018&19] dated 3rd July, 2018 regarding allotment of fund of Rs. 0.50 lakh from MLA fund for Ranikhet Utsav. In this connection this office approached to CDO, Almora for providing of Rs. 0.50 lakh to Cantonment Board. The said amount of Rs. 0.50 lakh has been received in this office on 18-07-2018 through NEFT.

Now the Ranikhet Utsav Samiti has requested to release the payment of Rs. 1.5 Lakh for expenditure incurred in Ranikhet Utsav.

Hence the matter is placed before the board for release of payment to Ranikhet Utsav Samiti.

16. ENGAGEMENT OF CARPENTER THROUGH OUTSOURCING AGENCY

It is submitted that the post of Carpenter in Cantonment Board Ranikhet was abolished by the higher authorities. The work of carpenter was being done by Shri Bahadur Ram, PWD Mazdoor, Cantt Board, Ranikhet since 11-06-2005 vide office order No. 374 dated. 11-06-2005. Now a letter has been received from Shri Bahadur Ram stating that he is unable to execute the works of carpenter due to heavy back pain and the doctor has advised him not to do heavy/physical work. In these circumstances the works of PWD section is affecting.

Keeping in view the necessity of PWD Section, there is a requirement of a temporary carpenter in PWD section to execute the departmental works of carpenter.

Hence the matter is placed before the board for engagement of temporary carpenter beyond sanctioned strength.

It is submitted that the computer programmer vide his letter dated 13-07-2018 has requested that the PDDE, CC, Lucknow vide their letter No. 54941/ABAS/Agra/Cantt, dated 19th June, 2018 has directed for entry of receipt, bills/procurement etc. for the FY 2016-17 and 2017-18 in ABAS (Accural Based Accounting System) and the said work was to be completed upto 30th June, 2018 but due to unavailability of staff, the work could not be completed till target date.

The PDDE has also directed to deploy the staff beyond the normal hours or additional staff, as the timelines prescribed are non-negotiable.

Keeping in view the heavy workload of regular works of office staff four additional data entry operator may be engaged beyond the sanctioned strength on purely temporary basis through outsourcing agency for live entry in ABAS till the finalization of ABAS work.

Hence the matter is placed before the board for engagement of four additional data entry operators.

18. RECRUITMENT TO THE POST OF RMO

It is submitted that a recruitment committee was constituted by the board vide CBR No. 10, dated 23rd Feb, 2018 for the appointment of RMO in Cantt Dispensary. In this connection an interview was conducted on 31 st May 2018 at 11:00 am in the office of the Cantonment Board Ranikhet, wherein four candidates appeared for interview. Out of the four, Smt. Rajeshwari Abhishek Asna d/o Duli Chand Bisen, Bilaspur, Chattisgarh has secured the highest marks in interview.

Hence the matter is placed before the board for confirmation of appointment of Smt. Rajeshwari Abhishek Asna d/o Duli Chand Bisen as RMO in Cantonment Dispensary Ranikhet on a pay band of Level No. 10 Cell 1 56100-177500.

19. SUPPLY OF MEDICINES IN CANTONMENT DISPENSARY

It is submitted that this office has invited e-tender for supply of medicines in Cantonment Dispensary Ranikhet. Three valid quotations could be received by this office within stipulated period. Wherein, the lowest rates have been quoted by M/s Krivid Pharmaceuticals, Aligarh, UP @ 71.88% less than MRP.

The company names of the medicines shown by the lowest bidder do not seem to be of standard companies or of any known/reputed companies.

Hence the matter was placed before finance committee for consideration. The finance committee vide its resolution No. 9 dated 11th May, 2018 recommended that as the L1 bidder M/s Krivid Pharmaceuticals has not mentioned the known/reputed companies, hence, work order for supply of medicines may be issued to L2 bidder M/s Edison Drug House. Consultation with CO, MH was recommended too.

The matter regarding supply of medicines was also discussed with the CO MH in the board meeting dated 26th May, 2018. The CO MH suggested that the concerned file be sent to his office for perusal.

In this connection, the documents regarding supply of medicines was forwarded to CO MH vide this office letter No. 191/Supply of medicines/2018-19, dated 30th May, 2018. In response, the CO MH vide their letter dated 14th June, 2018 intimated this office that “ Procurement of medicines of above companies is as per your discretion ”.

In this regard, a clarification has been sought from the L1 bidder vide this office letter No. 191/Supply of medicines/18, dated 19th June, 2018 regarding companies of medicines which is mentioned in his bid. In response, M/s Krivid Pharmaceuticals has submitted various certificates regarding his authorization from various pharma companies. A letter was again communicated to M/s Krivid Pharmaceuticals vide this office letter No. 191/Supply of Medicines/18, dated 21st June, 2018 and asked to the agency to provide the detail of medicines available with the companies mentioned by him in his bid.

In reply, M/s Krivid Pharmaceuticals has provided a list of medicines available with the companies mentioned by them in the bid.

20. REGARDING CLEANING OF RANIJHEEL AND TENDER FOR AUCTION OF FISHES.

To consider the matter regarding cleaning of Ranijheel for the prevention of aquatic animals.

It is submitted that Ranijheel is famous artificial lake in Ranikhet which has been constructed to attract tourists and the general public toward Raikhet. But, due to the heavy Rainfall, the water of Ranijheel is getting polluted and due to increase in silt, the depth of the jheel is getting shorter day by day. There are plenty of aquatic animals such as fishes in the Ranijheel, these fishes are also being badly affected by the silt, polluted water and the low level of oxygen.

Therefore for the sake of fishes and remove the silt it has become important for cleaning of Ranjheel, so that the storage capacity of the Rani Jheel can be improved.

In this regard an advice was obtained from the Forest Department, Almora through telephonic conversation, but due to non availability of clear direction for the cleaning of artificial lake, proper direction could not be received from their side.

Hence the matter is placed before the board for taking appropriate decision for the cleaning of Ranijheel and tender for auction of fishes.

21. TENDER FOR DISPOSAL OF JHULA GHASS.

OFFICE REPORT

It is submitted that the Board has been disposing of Jhula Ghass, which grows on oak tree through public auction. But it has been recommended in the Working Plan for Cantonment Forest, 2007 that this practice is not good for the health of forest and if at all required, this auctioning should be done only once in five year.

It is pertinent to mention here that the said auction was banned vide above quoted resolution in the year 2008. As per working plan, it is clearly mentioned in para 11.18.5 (Collection of non timber forest produce) that normally jhula and other NTFP should be collected not less than an interval of four year i.e. on every fifth year. Last time the auction for disposal of Jhula Ghass was made in the year 2013 and the rate received for disposal of Jhula Ghass from oak trees was @ Rs. 71,555/- in the year 2013.

In this connection sealed quotations were invited vide this office letter No. 177/Jhula Ghas/18, dated 17-07-2018 for disposal of Jhula Ghas from oak trees in Cantonment area from till 31-12-2018. Wherein 3 valid quotations could be received in this office and Shri Tara Singh Bisht s/o late Shri Swaroop Singh Bisht, Dugalkhola, Almora has quoted the higher rates @ Rs. 92,500/-.

Hence the matter is placed before the board for approval of highest rates for disposal of Jhula Ghas from oak trees in Cantonment area.

It is stated that after implementation of new lease policy dated 10-03-2017, the matter regarding extension/renewal of lease upto 31-12-2018 in respect of Sy. No. 89 was placed before the Board vide above quoted resolution and Board resolved that the proposal be sent to PDDE, CC, Lucknow as per the policy in both leases for renewal and extension.

In pursuance of above resolution a proposal was sent to the PDDE, CC, Lucknow vide this office letter No. 261/Extension/Renewal/Sy. No. 89, dated 29-07-2017 regarding extension of lease of Cantonment Code lease and renewal of lease in respect of Schedule VI of Cantonment Land Administration Rules, 1925.

After scruitney of the case, the PDDE, CC, Lucknow has observed & intimated to this office vide their letter quoted under reference that “ the subject lease was granted for dwelling house whereas only four seated latrine is available at the site, and you (this office) have also mentioned that there is no trace of existence of any building at the site from record, which attracts the violation of condition 1(5)/(6) of lease deed.

23. COMPOSITION OF UNAUTHORIZED CONSTRUCTION IN RESPECT OF SY.NO. 179/6 (CANOSSA CONVENT).

To consider the application of Sr. Veronica Dabreo, Superior, Canossa Convent Mall Road, Ranikhet regarding composition of unauthorized construction in Sy. No. 179/6.

OFFICE REPORT

The site comprising GLR Survey No. 179/6 admeasuring 0.50 acres classified as B-3 land held on Lease in Schedule VIII situated outside civil area held under the management of Defence Estates Officer, Bareilly Circle, Bareilly is entered in GLR in the name of Rev. Father Amedens O.M.B. Catholic Garrison Chapel.

The unauthorized construction is involved in the survey No. 179/6 which is carried by Canossa Convent authorities, Ranikhet. A proposal was sent to the GOC-in-Chief through Defence Estates Officer vide this office Letter No. 166/B.P./ADM/83, dated 28th January 1983. The DEO Bareilly Circle vide their office letter no. DEO/BLY/RKT/17 dated 22nd June, 2018 has informed to forward a fresh proposal along with new board resolution for composition of unauthorized construction.

Sr. Veronica Dabreo, Superior, Canossa Convent Mall Road, Ranikhet has requested this office to compound the certain unauthorized construction involved at the site. In this regard the matter was forwarded to CBLA and the CBLA vide his letter No. 39/165/L.A./99/254/2016, dated 14th March, 2016 opined that “ instead of demolition of the unauthorized construction, it can be compounded by accepting composition fee in terms of money as the Hon’ble Board thins reasonable ”.

In this connection he has quoted the provision of Sub Section (1) of Section 248 wherein it is provided that “ Board may instead of requiring the alteration of demolition of any such building or part thereof accept by way of composition such sum as thins reasonable ”.

Now Sr. Veronica Dabreo, Superior, Canossa Convent Mall Road, Ranikhet vide his application dated 22-05-2018 has admitted his offence and requested this office vide his letter dated 08-10-2016 for composition of offence of unauthorized construction, for which composition plan has also been submitted by the applicant.

As per technical report dated 07-07-2018, the Unauthorized Construction is as per building bye laws and land policy 1995 and also verified the site for assessment. The cost of unauthorized construction is Rs. 3,74,335.00.

The Board may consider the matter regarding composition of offence of unauthorized construction by imposing suitable composition fee.

24. RENOVATION OF DILAPIDATED BUILDINGS

To consider the matter pertaining to issue of notice under section 144 to residents of the Cantonment for repair of dilapidated buildings which are in an insanitary stage and repair/restoration of buildings which area dangerous to persons passing by or dwelling in the neighborhood.

With reference to aforementioned sections of the Cantt Act, 2006, the CBLA has rendered his valuable advice vide report dated 19-02-2016, i.e. “I have perused some photographs of dilapidated condition of the building concern. Cantonment law does not permit any building in ruinous or in dilapidated condition. The intention of the Legislature is that every dwelling place must be fit for human habitation. In case any building is in dilapidated and ruin

ous condition, then the permission for repairing should be given.

In this regard, intention of the Legislature is clearly laid down under the provisions of Section 297 as well as 144 of the Cantonment Act, 2006. Therefore, I am of the considered opinion that the application of allowed.” PCB vide its resolution No. 22, dated 22-07-2016 directed that a suomoto inspection be done by CEO of all such properties to enable the Cantonment Board to such cases not reported.

Deepa Belwal w/o late Shri Devendra Belwal, Shri Umesh Chandra Belwal, Shri Chandra Datt Belwal, Shri Jagdish Chandra Belwal, Shri Naveen Chandra Belwal sons of the late Shri Madhawanand Belwal, Shri Naveen Chandra Belwal s/o Shri Leeladhar Belweal, Shri Ganga Datt Belwal, Shri Chandra Datt Belwal, Shri Krishna Nand Belwal s/o late Shri Amba Datt Belwal jointly held on lease in form ‘A’ Cantt Code, 1899.

Shri Chandra Datt Belwal s/o Shri Prem Ballabh Belwal has applied in this office for mutation in Sy. No. 328/1 in favour of legal heirs of late Shri Prem Ballabh Belwal s/o late Shri Dharmanand Belwal by way of inheritance. But the names of Shri Prem Ballabh Belwal s/o late Shri Dharmanand Belwal and shri Dharmanand Belweal or his legal heirs are not entered in the GLR of Sy. No. 328/1.

Shri Chandra Datt Belwal s/o Shri Prem Ballabh Belwal has stated vide an affidavit dated 27-09-2017 that Shri Kulomani Belwal and Shri Dharmanand Belwal were brothers. Shri Kulomani Belwal was the elder brother and was head of the family as Hindu families. Therefore, the property situated in Sy. No. 328/1 was purchased in the name of Shri Kulomani Belewal and applicants also have their rights on the property and their names be enter in the GLR of Sy. No. 328/1.

As the names of Shri Dharmanand Belwal or his legal heirs are not enetered in the GLR of Sy. No. 328/1, the matter was forwarded to CBLA for obtaining legal advice vide this office letter No. 261/Legal Advice/2018, dated 28 th March, 2018. The CLBA vide his letter dated 12th April, 2018 has advised that “ it is clear from the record that Prem Ballabh, Amba Dutt and Leeladhar were the sons of Dharmanand Belwal. Out of three sons the descendants of Amba Dutt and Leeladhar have already been mutated in the GLR. Threfore, the name of the present applicants, who are the descendants of third brother namely prem Ballabh Belwal, be also mutated on the same footing. There is no illegality in doing so ”.

In this connection an advertisement was published for inviting objection regarding mutation in Sy. No. 328/1 vide this office letter No. 261/Mutation/Ad/18-19 dated 27th April, 2018, as per report of Record Keeper dated 26th June, 2018 no objection is received within the stipulated period.

As per technical report dated 18th Jan, 2018 unauthorized construction, encroachment, sub division of site and change of purpose is not involved at the site.

Hence the matter is placed before the board for consideration.

25. Considered. The Board has resolved that occupancy rights of GLR Sy. No. 328/1 be transferred in favour of legal heirs of late Shri Prem Ballabh Belwal s/o late Shri Dharmanand Belwal by way of inheritance after completion of all the formalities. Mutation fee amounting to Rs. 500/- also be recovered.

26. ENGAGEMENT OF ARCHITECT FOR CONSTRUCTION & DEVELOPMENT WORKS

It is submitted that the whole lease land of Sitapur Eye Hospital measruing 1.113 acres has been handed over to the Cantonment Board Ranikhet by the authorities of Sitapur Eye Hospital peacefully. As the above land is now under the posession of Cantonmnet Board, a number of development projects are proposed to be under taken by this office on said land such as Commercial Complex & Multistorey parking.

For initiating the procedure to undertake the development project, building design, preparation of D.P.R, plans & estimates of the projects at the initial stage, it is necessary to engage a qualified architect/consultant on contract basis.

In this regard tenders were invited vide this office letter No. 116/advertisment/18 dated 30th may 2018, through publishing an advertisment in daily newspapers as well as in website. Four valid quotations were received by this office within the stipulated period and the lowest rate has quoted by M/s Urban Bakhili, haldwani @ 2.5% of the total estimated cost of the project, which will be payable by the board to the contractor.

The board may consider and approve the lowest rate i.e, 2.5 % for engagement of architect.

It is submitted that the PDDE, CC, Lucknow has advised to Cantonment Board to review the extension of civil area after Census 2011 population figures were notified in view of the provision of Section 46(2) of Cantonment Act, 2006. It has also advised that in case boundaries of civil area need any change, proposal for consideration of the Central Govt. may be forwarded within a stipulated time frame. The PDDE also directed to make an assessment of requirement for change of boundaries of Civil Area, keeping in view the increase in population after the Census 2011, if any.

In this connection it is also submitted that as per record available in this office, the civil population of Cantt Area Ranikhet has not increased between the two census i.e. 2001 and 2011 i.e. (2001 - 19055 and 2011 18886).

In this regard, the matter was placed before the board and the board vide CBR No. 19, dated 26th May, 2018 resolved that a report be prepared by technical section of Cantonment Board and Station Headquarter and put up in the ensuing board meeting for elaborate discussion.

In compliance of the board resolution, a letter was forwarded to Station Headquater, Ranikhet for inspection with technical section of this office of Army Butchery area for review of boundaries of the civil area in Cantonment. In response, The Station Headquater, Ranikhet has informed that the said land is A1 defence land and the proposal mooted by Cantonment Board is not congruent to land records. The land has already been earmarked for use of military units and is unavailable for transfer as proposed in your board meeting .

Hence the matter is placed before the board for consideration of matter regarding review of boundaries of civil area.

27. Considered and discussed at length. PCB decided to maintain the status quo in the boundaries of civil area. But Shri Mohan Negi, Vice President suggested to atleast forward a proposal to higher authorities regarding extension of boundaries of civil area in the Kachahari Line area (where shops are exists on B-4 land). The CEO agreed to this.

28. DEDUCTION OF WATER & ELECTRICITY CHARGES FOR DEVELOPMENT WORKS.

Fixation of water & electricity charges deduct from the bill amount of contractor under various D-2 head works.

It is submitted that, a lot of development works under D-2 head are carried out by the board such as building works, drains,waterline supply works etc, for which Water and Electricty has been provided to the Contractor by the Cantonment Board.

Hence, Board may give sanction to deduct water charges @ 0.5% of total billing amount paid to the contractor. The consumption charges of electricity may be recovered on the basis of per unit charge electricity consumed by the contractor and the same will be verified by Technical section of this office.

Application received from Shri Mahipal Singh (Shop No. 63), near Vijay Chowk, Ranikhet for the permission for repair of shop.

It is pertinent to mention here that earlier Shri Mahipal Singh vide his letter dated nil approach to Station headquarter, Ranikhet for waiving off taxes/rent of the said shop due to his disability. The Station Headquarters, Ranikhet vide its letter No. 313/Cantt Gen/Q, dated 10 th July, 2017 requested to this office that due to disability of veteran, the taxes/rent of the said shop be waived off. The matter was placed before the Board on its meeting held on 09th December, 2017. As per the above letter from station Headquarter, Ranikhet the Board vide its resolution No. 23, dated 09th December, 2017 has resolved that as per section 115 of Cantt Act, 2006 the matter be forwarded to GOC-in-chief, Central Command Lucknow for obtaining their sanction for waiving off rent of shop No. 63.

The Cantonment Board, Ranikhet, vide its letter No. 237/Sh.No.63/Tax/143, dated 22nd January, 2018 has forwarded the matter to GOC-in-Chief, through Principal Director, DE, Central Command, Lucknow Cantt for obtaining their sanction. Presently the matter is pending with Headquarter, Central Command, Lucknow.

Presently the outstanding dues for the said shop against Mr. Mahipal Singh is ` 53,460/-. The Board may consider the matter as special case to issue permission for prevention of seepage of roof of the said shop in upcoming rainy season to the applicant on under mentioned conditions:-

1. The site is under jurisdiction of Cantonment Board and after above construction the shop will remain as the property of Cantonment Board under possession of cantonment Board.

2. The expenditure is curried by the applicant will not be adjusted into any bill released by Cantonment Board to the applicant.

3. After repair/construction the rent increased by Cantonment Board will be accepted to the applicant.

4. No other change to the existing nature of the shop would be done.

No. 4/34/2017-P&PW(D), dated 19th July, 2017 regarding enhancement of Fixed Medical Allowance of pensioners from Rs. 500/- to Rs. 1000/- per month. It is submitted that the sanction under FR 44 read with para 14 of the Memorandum of Settlement has been accorded from the PDDE, CC, Lucknow for the grant of dearness allowance @7% of their Basic Pay w.e.f. 01-01-2018 to the employees of the Cantonment Board, Ranikhet as per the terms and conditions in Uttarakhand G.O. No. 25/XXVII(7)/02/2016, dated 09-05-2018.

Hence the matter is placed before the Board for the approval of dearness allowance.

44. MUTATION IN RESPECT OF SY. NO. 99/254/3

To consider the matter regarding mutation in Sy. No. 99/254/3.

OFFICE REPORT

It is submitted that as per GLR available in this office the 2nd term of Lease (lease in schedule VI of CLAR 1925) of Sy. No. 99/254/3 has been expired on 30-09-1994. The matter regarding renewal of lease was placed before the board under New Lease Policy dated 10-03-2017.

Wherein the board vide CBR No. 13, dated 21st June, 2017 resolved to forward a proposal to higher authorities regarding condonation of breach of lease terms and renewal of lease. Accordingly this office forwarded a proposal to PDDE, CC, Lucknow vide this office letter No. 261/Renewal/Sy. No. 99/254/3, dated 17th Aug, 2017.

In response, the PDDE, CC, Lucknow vide their letter No. 31723/LC2, dated 14th Nov. 2017 has given their sanction for condonation of breach of lease terms i.e. 1(8) and renewal of lease in Sy. No. 99/254/3.

As per GLR, the property is mentioned in the names of Sarvshri Jagdish Prasad, Kailash Chandra, Harish Chandra, Om Prakash sons of late Lakshi Narayan. At present the said property is under possession of Shri Hem Chandra Joshi s/o Shri Pan Dev Joshi vide sale deed dated 02-02-2002.

Before initiating the process of renewal of lease in Sy. No. 99/254/3, it is necessary to mutate the property in the name of Shri Hem Chandra Joshi. In this regard, Shri Hem Chandra Joshi has applied for mutation in respect of Sy. No. 99/254/3 in his favour vide application dated 16-01-2018.

In this connection this office has invited objection regarding mutation in Sy. No. 99/254/3 by publishing an advertisement in daily news papers. Wherein no objection is received in this office within stipulated period.

Hence the matter is being placed before the board to mutate the property situated in Sy. No. 99/254/3 in favour of Shri Hem Chandra Joshi so that renewal process of said lease could be finalized.

RESOLUTION

44. Considered. The Board has resolved that occupancy rights of GLR Sy. No. 99/254/3 be transferred in favour of Shri Hem Chandra Joshi after completion of all the formalities. Mutation fee amounting to Rs. 500/- also be recovered and renewal process of said lease be finalized.

45. WORKS EXECUTION UNDER MP/MLA FUND.

To consider the matter regarding execution of various works those are carried out with MP/MLA fund.

It is submitted that the Hon’ble MLA, Shri Karan Mahra has allotted fund for the execution of various development works within Cantonment area. The detail of works are as under:-

1. Renovation of Naula located below Kendriya Vidhayalaya Colony - Rs. 2.5 lakh.

2. Construction of 2 Bio-toilets in Cantonment area - Rs. 5.0 lakh.

3. Fencing of plantation area within Cantonment - Rs. 5.0 lakh.

It is also submitted that as per Uttarakhand Govt. letter No. 2023/XI/17/56(21)2007 TC-I, dated 05th December, 2017 no tenders were required for the work execution by MLA fund up-to 5 lakh.

Hence the matter is being put-up before the Board for noting.

OTHER DISCUSSION POINTS

1. Shri Sanjay Pant, Elected Member raised a point regarding allotment of water connection in Kumpur area. The CEO instructed the work supervisor to prepare a detailed report on the same so that approval can be accorded in the next board.

2. Shri Mohan Negi, Vice President raised a point that the Cantonment Board issues licence under section 277 of Cantt Act 2006 to shopkeepers. But the sampling/inspection of food items is being done by State Govt. authorities due to which the shopkeepers have to face difficulties. So inspection/sampling of food items may be done by Cantonment Board through Sanitary Inspector instead of State Govt. authorities. The CEO informed that the Sanitary Inspector of Cantonment Board does not hold the certification regarding food inspection. Further the CEO informed the board that a proposal regarding the same has been sent to the higher authorities and any further action can only be taken after due guidelines/instructions are received on the said matter. The PCB opined that Cantt Board staff should be present at the time of sampling, as is the practice now, so that no shopkeepers of Ranikhet have to face any unnecessary inconvenience till then.

3. The elected members informed the board that the dustbins placed by Cantonment Board at various places are being damaged by various mischievous people and vehicles and has also been seen that people throw the garbage outside the dustbins and litter around. So the board may impose fine on these people. The PCB said that it is not possible to monitor these cases in entire Cantt area. The Vice President insisted that the board has to impose fine on such people. The PCB suggested that the market area may be monitored by cantt staff and a specific amount of fine may be imposed on such offenders in market area.

The PCB also suggested that cantt board may approach to Local Adminisrative Authorities for seeking their help in smoothly implementing the above. The rates were fixed between Rs. 50/- and Rs. 100/-
